Terms of Service

Please read these terms of service (“terms”, “terms of service”) carefully before using tamcreative.com website (the “service”) operated by Tam Creative (“us”, ‘we”, “our”).

 

Conditions of Use

We will provide their services to you, which are subject to the conditions stated below in this document. Every time you visit this website, use its services or make a purchase, you accept the following conditions.

 

  • Please note that all original artwork files created by Tam Creative remain as the property of Tam Creative even after the digital or printed piece is released and may be used in Tam Creative's own digital and print marketing. Duplication/Distribution of designs without permission is prohibited. 

  • Please be advised that you may be charged for any extra time spent when any of our graphic designers or photographers modify your order. Please check spelling, sizes, fonts, numbers, etc. before approving your order. 

  • Tam Creative will not take any responsibility for any mistakes or compliance issues which may exist in your order after your approval, or for any quality issue in the files that are sent by our clients. 

  • Tam Creative will not guarantee that colours will look exactly the same on your screen as it does on our equipment or the finished product. We do not guarantee that our colours will match the colours seen on your printer, another printer, computer monitor, or any other device. 

  • No returns or refunds. We will not refund a job based on turnaround time. If you have a time-sensitive job, please be sure to notify customer service at the time of placing your order to see if we can accommodate.

  • Turnaround time on printing orders begins once full payment has been received for your order. In addition, while Production Turnaround includes printing, cutting, and binding, it does not include mailing or shipping transit times. If you are having the order shipped, you should allow additional business days for delivery. Once a package is shipped, Tam Creative is not responsible and will not be liable for late or damaged packages during the shipping process. Arrival dates are only estimates because they can be subject to unforeseen delays in transit.

  • Use of trademark logos: Tam Creative is not affiliated with trademark owner. Display of real estate trademarks on designs are for purposes of description and identification. This does not constitute an endorsement by the trademark owner of Tam Creative products and services. Tam Creative is not authorized by, sponsored by, or associated with the trademark owner. As an authorized agent or representative, you agree that any artwork submitted or requested by you is a representation and warranty to us that you have written authorization, if needed, to order its reproduction.

  • Payment is due at the time of placing an order and any additional or incremental services, will be billed upon completion of the iGuide delivery, using the same method of payment provided during the original order.

  • Please note: Any Incremental Charges related to Extra Square Feet, based on the Total Billable Area per property (versus what was provided on original order request), will be processed up to 45 days after the appointment.

  • Any Cancellation or Rescheduling requests received after 5pm on the business day prior to the appointment, will incur a $100 Sameday Cancellation/Rescheduling Fee.

  • To cancel a shoot on Monday, you must contact us before 5 pm on Friday to avoid the $100 fee.

  • Parking fees paid by Client.

  • Any changes to the Date of an appointment, after the order has been placed, will result in a $25 Admin Fee.

  • If the photographer cannot start within 15 minutes of the scheduled appointment start time and/or based on THEIR best judgement, do not feel they can complete the appointment in the available time, a $100 Sameday Rescheduling Fee will be applied.

  • Any changes requested after the delivery of Tam Creative iGuide materials, will be subject to an Admin Fee of $25 per Change Request.

  • Extra charges will be applied for any return or repeat visits (i.e. Reshoots) and will be determined on a case-by-case basis.

  • There will be an additional charge of $50 for Weekend Shoots in some areas, and Holiday Shoots may incur an incremental charge as well.

  • Travel Charges will be applied to those appointments outside of our regular service areas and will be determined on a case-by-case basis.

  • A Reactivation Fee of $25 will be applied for any request to ‘unlock’ an expired iGuide View.

  • Weather Policy: We do not take responsibility for the weather. The client has the option of rescheduling the appointment in the event of poor weather conditions, within the terms mentioned above, and/or schedule another appointment to capture exterior images at a cost of $85.

Communications

Much of our communication is electronic. Every time you send us an email or visit our website, you are going to be communicating with us. You hereby consent to receive communications from us. If you subscribe to the newsletter on our website, you are going to receive regular emails from us. We will continue to communicate with you by posting news and notices on our website and by sending you emails. You also agree that all notices, disclosures, agreements and other communications we provide to you electronically meet the legal requirements that such communications be in writing.

 

User Account

If you are an owner of an account on this website, you are solely responsible for maintaining the confidentiality of your private user details (username and password). You are responsible for all activities that occur under your account or password.

We reserve all rights to terminate accounts, edit or remove content and cancel orders in their sole discretion.
